Information we may collect about your contacts

When using our Solution, you may create and update personal data relating to your contacts

("Client Data") such as email address, first name, last name, date of birth, gender and other

information.

Client Data may also be entered directly into the Solution by your contacts through the use of

features such as Forms, Automation and API integration with other applications, which are

subject to our Terms of Use but are not otherwise limited or controlled by us.

 

When Client Data is created or updated by you or your contacts it is possible we may

inadvertently, and against our Terms of Use, process "Special Categories" of personal data such

as racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union

membership.

 

We only ever use Client Data to provide the services of our Solution to you, such as sending

email campaigns, tracking email opens and tracking clicks on links, and do not share Client Data

with third parties, except where required to do so by law.

 

Storage of your personal data

The personal data that we collect from you is stored within supplier data centers in the United States (our

database servers) and personal data is transferred to our email delivery servers in the United

States for the purposes described in this Privacy Notice.

 

If we do this, the personal data will continue to be subject to one or more appropriate

safeguards set out in the law. These might be the use of model contracts in a form approved by

regulators, or having our suppliers sign up to an independent privacy program approved by

regulators. EmailConcert is subject to the investigatory and

enforcement powers of the Federal Trade Commission (FTC). the possibility, under certain

conditions, for the individual to invoke binding arbitration

o EmailConcert is required to disclose personal information in response to

lawful requests by public authorities, including to meet national security or

law enforcement requirements

All information that we collect or you provide to us through our Solution is stored on secure

servers and is encrypted using SSL technology.

You are responsible for keeping your Login Profile details (email address and password)

confidential. We ask you not to share your password with anyone and advise that you change

your password regularly.

 

How we use your personal data

We use the personal data we collect from you or that you have provided to us in the following

ways:

• To check your identity when logging into our Solution

• To provide you the with services of our Solution, communicate with you about your use

of our Solution, respond to your enquiries, provide help & support and for other

customer service related purposes

• To tailor the content and information that we may send or display to you within our

Solution, to offer location customization, to offer personalized help and instructions and

to otherwise personalize your experiences while using our Solution

• To update our records about you

• To send periodic emails relating to our services

• To better understand how users access and use our Solution

• To evaluate and improve our Solution and to develop new features, products and

services

• To comply with legal obligations, as part of our general business operations, and for

other business administration purposes

How we share your information

We may share your information with third party service providers who use this information to

perform services for us, such as hosting providers, technology companies, software developers,

auditors, advisors, consultants, customer service and support providers, as well as those who

assist us in providing the services of our Solution.

 

We may also disclose your personal information to third parties:

• Where required or authorized by law

• To implement the terms of any agreement we have with you

• To assist the lawful investigation of a law enforcement authority

• To protect the rights, property or personal safety of another EmailConcert

customer, any member of the public or EmailConcert

• The assets and operations of the business are transferred to another party as a going

concern

• As otherwise described in this Privacy Notice

We may also provide information about our dealings with you to credit reference and fraud

prevention agencies.

How long we retain your personal data

We retain the personal data collected from you by us, or provided by you to us, for a period of

time dictated by either a legal obligation or where it is necessary in order for us to provide the

services of our Solution to you.

 

The period of time we retain personal data for relates to and is in accordance with any terms of

agreement that are in place between you and us.

Access, amending, or limiting the use of your information

If you would like to access, amend, or limit the use and disclosure or your personal data,

including Right to Be Forgotten, or receive a copy of all of the personal data we store relating to

you as an individual a request can be made in writing:

• Your EmailConcert account / business name

• Details of any specific information you require

Once we receive your request we'll get back to you within 30 days, providing your identify has

been successfully verified in relation to the request you have made.

Please note that we cannot process requests for information over the phone - you must follow

the process above.

 

Changes to our Privacy Notice

Any changes we may make to our Privacy Notice in the future will be posted on this page and /

or in our Terms of Use and, where appropriate, notified to you by email.
